Virtual Asset (Service Providers) (Amendment) Bill, 2026 (LG6, S3)

This Bill amends the Virtual Assets (Service Providers) Act to clarify that certain tokenised interests issued by regulated funds are not treated as virtual assets, align definitions with existing funds legislation, and repeal a prior amendment Act.

Key Provisions: 

1. Clarifies scope of “virtual asset issuance” by excluding the issuance of digital equity tokens by tokenised mutual funds and digital investment tokens by tokenised private funds that are regulated under exiting funds laws.
2. Introduces and aligns definitions for digital equity tokens, digital investment tokens, tokenised mutual funds and tokenised private funds with the Mutual Funds Act and Private Funds Act to ensure legislative consistency.
3. Repeals the Virtual Asset (Service Providers) (Amendment) Act, 2025, removing superseded provisions from the statute book.
