Mutual Legal Assistance (United States of America)(Amendment) Bill 2026 (LG40,S1)

This Bill updates the Cayman Islands’ mutual legal assistance framework with the United States by changing the entity responsible for providing assistance to the United States and providing protection from liability for that entity in the exercise of its functions.

 

Key Provisions:

  1. Transfers responsibility for the exercise of functions of the Cayman Mutual Legal Assistance from the Chief Justice or a designated Grand Court Judge to the Attorney General. As a result, the Solicitor General will now be notified of a request from the United States and be able to participate in related proceedings.
  2. Protects the Cayman Mutual Legal Assistance Authority from liability in damages when carrying out its functions, except in cases of bad faith, and caps the potential legal costs recoverable from the Cayman Mutual Legal Assistance Authority.
  3. Modernises outdated references to legislation, amends certain provisions to render them gender neutral in their application, and restructures other provisions in keeping with modern drafting practices.
